Commentary by Attorney Michael Grossman
While the exact cause of the crash isn't officially confirmed right now, any mention of intoxicated driving is going to raise red flags. If the allegations are true, and if alcohol was the intoxicant, that would require investigations into where the alcohol came from. Here's why.
Texas dram shop laws hold alcohol providers accountable if they serve alcohol to someone who is obviously intoxicated. If alcohol played a role in this crash, investigators should determine whether an establishment over-served the driver before they got behind the wheel. If an alcohol provider ignored obvious signs of intoxication, they may share responsibility for what happened.
Unfortunately, this often goes overlooked, as authorities sometimes focus so much on looking at the crash scene that they neglect any details beyond it that families need to know. Like I said, the circumstances leading up to this crash aren't confirmed yet, but it's important to know if authorities are taking the right steps to get the whole story.
