Commentary by Attorney Michael Grossman
When young people are seriously hurt in a crash, it’s tempting to chalk it up to inexperience or poor decisions. But assumptions don’t lead to answers—and they don’t explain why a vehicle suddenly leaves the roadway at a time when few others are out.
1. Did the authorities thoroughly investigate the crash?
A single-vehicle wreck in the early morning hours deserves close attention from crash investigators. Did they examine the path of the vehicle for signs of sudden correction or braking? Did they reconstruct the events leading up to the impact? Too often, single-car crashes—especially involving teens—don’t get the same scrutiny as more complex wrecks, even though the consequences can be just as severe.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
When a luxury vehicle like a BMW drifts off course and hits an embankment, a mechanical failure should never be ruled out without inspection. Problems with steering components, tire blowouts, or electronic stability systems could all contribute to a sudden loss of control. These aren’t always obvious at the scene, and unless someone checks for them, they tend to go unnoticed.
3. Has all the electronic data relating to the crash been collected?
Modern vehicles like this BMW come equipped with detailed onboard data. That includes vehicle speed, braking, steering input, and system alerts in the moments before impact. These details could help determine whether the driver was reacting to something or if the vehicle itself wasn't responding correctly. If that information hasn’t already been secured, it could fade before anyone has a chance to understand what really happened.
There’s no such thing as a minor crash when it sends young people to the hospital. Every effort needs to be made to understand what went wrong—and to ensure the same thing doesn’t happen again.
Key Takeaways:
- Single-car crashes involving teens need more than surface-level assumptions about inexperience or distraction.
- Mechanical failure or system malfunctions must be ruled out with a thorough inspection.
- Data from the vehicle could clarify the driver's actions and whether the vehicle responded properly.
