Commentary by Attorney Michael Grossman
With preliminary statements like these, people may be quick to assume everything is open-and-shut. Authorities seem to believe one person made a clear mistake, so what more is there to discuss? Well, the law isn't so black-and-white that only one potential contributing factor matters. It's important victims and families know all of the facts just in case multiple factors contributed to the accident.
For example, is there something wrong with this intersection? Did everyone's airbags and seatbelts function properly? Did any of the vehicles have automatic driving or collision avoidance systems that may not have reacted appropriately to the situation? Was alcohol involved? Likely or not, these are important questions to ask, yet I've seen many cases where authorities simply overlooked them.
That's why it's important for folks to consider what kind of answers they're getting from authorities. If there's a concern they may not be telling the whole story, it's possible more thorough independent investigations might reveal something new.
