Commentary by Attorney Michael Grossman
When I read about a crash like the one in Trinity that left a pedestrian dead, many might assume it was just an unfortunate accident. However, without a thorough investigation, it’s impossible to say for sure what really happened. That’s why it’s important to ask the right questions to ensure all potential factors are examined.
First, did the authorities conduct a thorough investigation? Pedestrian crashes often have limited physical evidence, making it crucial that investigators gather as much information as possible. Were there any nearby cameras that might have recorded the incident? Did officers interview witnesses and the driver involved? Were visibility conditions and road lighting considered? These details could help clarify how and why the crash occurred.
Second, has anyone looked into whether a vehicle defect played a role? If the driver’s vehicle had braking issues, malfunctioning headlights, or other mechanical failures, that could have affected their ability to see or stop in time. While such issues may not be common, they’re serious enough that they should always be ruled out.
Lastly, have investigators gathered all available electronic data? Modern vehicles contain event data recorders that store critical information about braking, speed, and steering just before a crash. If the vehicle involved had this technology, retrieving the data could help determine whether the driver tried to stop or swerve. Additionally, traffic or security cameras in the area might provide insight into what happened in the moments leading up to the crash.
At the end of the day, answering these questions could be essential to understanding what really happened and why. A thorough examination of all three of these issues—including the quality of police investigations, possible vehicle defects, and electronic data—is the least that can be done to ensure that those affected by the crash receive the clarity they deserve.
