Commentary
People sometimes read that a vehicle was "parked" and just assume that automatically puts the moving vehicle in the wrong. However, it's important to know where the truck was parked, how visible it was, and why it was there. Let me give an example of why that's so important.
Not long ago, we had a case involving a "parked" truck. What that actually meant was that the truck was broken down on the highway as the result of months of neglected maintenance. Not only that, but the truck driver never put out warning cones or flares, which is not just irresponsible but actually a violation of federal regulations. So rather than the collision just involving a "parked" truck, it involved a semi that needlessly broke down and obstructed traffic for completely avoidable reasons, resulting in a serious crash.
I'm not saying that happened here—it's far too early to tell. But that's my point. Right now, there isn't enough evidence to say what exactly went wrong. That's going to be up to more thorough investigations, and my hope is those investigations are thorough enough to consider both why the vehicle struck the semi and why the semi was stopped on the freeway in the first place.
