Commentary by Attorney Michael Grossman
One of the more common questions I get from people involved in single-vehicle accidents is: How can I make sure my side of the story is being considered fairly? The unfortunate reality is that authorities sometimes rush to judgment or move on without considering all of the facts. This can clearly create issues if they're overlooking complex or extenuating circumstances. To help avoid this, it can be helpful to keep a few key questions in mind.
Did investigators take the time and have the right tools to fully analyze the crash? A vehicle leaving the roadway could be influenced by road hazards, poor visibility, or even an evasive maneuver. Did authorities document tire marks, road conditions, and environmental factors like lighting and weather? If key details weren’t recorded, important evidence may have been missed.
Did they consider whether a vehicle defect played a role? Mechanical failures—such as brake malfunctions, steering issues, or a sudden loss of power—can cause a driver to lose control unexpectedly. Additionally, seatbelt or airbag failures could make injuries worse than they should have been. Was the vehicle properly inspected before it was repaired or scrapped?
Did they secure all available electronic evidence? The vehicle’s Engine Control Module (ECM) may have recorded critical data, such as speed, braking, and steering inputs leading up to the crash. GPS records, cellphone activity, or nearby surveillance footage could also provide key insights. Were investigators careful to preserve this information?
If these questions weren’t fully addressed, there’s a risk that the investigation left out key details. That's when people can decide if they need a second set of eyes looking things over to feel confident the facts are being told properly.
