Commentary
Evidence may ultimately show there wasn't alcohol involved here, but if it was, that wouldn't necessarily make things open-and-shut. While a lot of the focus is on the alleged intoxicated driver (rightfully so), there also needs to be an investigation into where the alcohol came from. If a local alcohol provider unlawfully over-served the driver, they, too, could be responsible for contributing to the accident.
In Texas, if a bar, restaurant, club, or similar establishment serves someone who is obviously intoxicated, those establishments may face criminal investigations, fines, or even liability for the injuries their actions led to. Too often, authorities will go after drunk drivers, then move on. Meanwhile, there are victims and families being left in the dark, and there could be a local establishment continuing to put the community at risk. That makes it crucial to consider this possibility anytime alcohol comes up as a possibility. If alcohol was indeed a factor here, this incident wouldn't likely be an exception.
