Commentary by Attorney Michael Grossman
After any serious collision, people often wonder whether it was just a moment of inattention, or if there’s something deeper that hasn't come to light yet. While surface-level reports may point to a clear sequence of events, that doesn’t always mean the story is complete.
Did the authorities thoroughly investigate the crash? When a rear-end crash leads to serious injuries, it’s important that investigators dig into more than just the obvious damage and position of the vehicles. Rear-end collisions can look simple at first glance, but understanding what really happened requires more effort. Did investigators reconstruct the vehicle paths with precision? Did they examine traffic flow and driver behavior in the minutes leading up to impact? Not every agency has the training or tools for in-depth crash reconstruction, and unfortunately, that can leave critical details unexplored.
Has anyone looked into the possibility that a vehicle defect caused the crash? A mechanical issue in either vehicle could change how this crash is understood. For example, if the trailing vehicle’s brakes didn’t respond properly, or if a sensor failed to alert the driver in time, that's not something visible from the outside. Serious crashes should always prompt a look under the hood, especially when the driver of the striking vehicle walks away unhurt while the person hit suffers major injuries. Defect-related crashes don’t always leave clear evidence unless someone knows what to look for.
Has all the electronic data relating to the crash been collected? In modern vehicles like the 2019 Jeep and even the 2011 Buick, onboard computers may hold a wealth of information. Data showing speed, braking and steering can reveal whether either driver had time to react. Cell phone records or GPS logs might also help clarify attention levels or distraction. If investigators didn’t pull that information early, the opportunity to do so may already be slipping away.
When answers are in short supply, it’s easy to accept the simplest explanation. But doing so may overlook hidden causes or missed warning signs. That’s why it's worth asking tougher questions early, before evidence disappears.
Key Takeaways:
- A surface-level investigation may miss key facts about how and why the crash happened.
- Mechanical failures in either car could have played a hidden role.
- Electronic data might hold answers that physical damage alone can't provide.
