Branton Delaney Smith Injured in Motorcycle Accident in Bryan, TX
Brazos County, TX — October 28, 2023, Branton Delaney Smith was injured as the result of a motorcycle accident at around 1:15 a.m. along South Texas Avenue.
Authorities said in their statements that the crash happened off the corner of South Texas Avenue and South College Avenue.

According to officials, 50-year-old Branton Smith was on a Harley-Davidson motorcycle said to be going southbound along Texas Avenue. At the intersection, the motorcycle apparently came into contact with the curb, causing the bike to lose control and crashed along College Avenue. Smith was thrown from the motorcycle as a result, and Smith sustained injuries described as incapacitating.
Commentary by Attorney Michael Grossman
Right now, public information from authorities alleges that Smith was under the influence of alcohol. However, there doesn't appear to be a listed toxicology report, a recorded BAC, recommended charges, or any details about where the victim supposedly got their alcohol. To be clear, I don't say this to suggest authorities are mistaken, but this is a good example of why I take preliminary statements from authorities with a grain of salt.
I've seen plenty of investigations where authorities mentioned alcohol as a contributing factor. But after further examination, it turns out they only said that due to the time of the crash or other circumstances where alcohol is common. Alternatively, I've also seen situations where alcohol was a factor, but authorities didn't do their due diligence preserve evidence. This can be especially serious in situations when a local bar could otherwise be responsible for over-serving someone and contributing to their injuries, which requires a lot of evidence.
To be clear, I can't say nor would I attempt to say what happened here. That's not my place. My point is that it's always important to not only know what authorities are saying about a crash but also why they're saying it. Right now, these reports are likely far from telling the whole story.
