Commentary by Attorney Michael Grossman
Reported details suggest alcohol could be a factor here. While folks sometimes think that makes a crash open-and-shut, it can actually make things a lot more complex for the victims and families involved.
This is primarily due to many drunk driving accidents involving not just a drunk driver but also a local alcohol provider who illegally over-served them. If evidence shows a bar or similar establishment served someone who was obviously intoxicated, and that leads to people getting hurt, Texas law allows for those establishments to be held accountable. They may face criminal investigations, fines, license suspensions, or liability for the resulting deaths or injuries.
Unfortunately, this isn't the sort of thing authorities tend to look into on their own. They generally are just trying to find someone to blame. Beyond the crash scene, details tend to slip through the cracks. In my experience investigating hundreds of negligent alcohol providers, victims and families have to ensure the right questions are being asked about their situation. Otherwise, they may only get half the story, and that could mean letting someone off the hook for their role in a devastating fatal accident.
