Commentary by Attorney Michael Grossman
With single-vehicle wrecks, it's always important to consider even unlikely possible factors. Anything from mechanical issues to tire blowouts to product defects to road hazards can cause this type of accident. Those aren't often within the scope of a typical police investigation, though, so they may fly under the radar unless there's a more thorough independent accident reconstruction.
I know some folks are just too skeptical to think a crash like this could be ever be unavoidable. Obviously, driver error is the more common explanation. Especially at this time of day, I've handled enough cases against bars negligently over-serving people, for example, to know that better than most. But if people jump to conclusions, it's only a matter of time before something important slips by. It's happened plenty of times before, and it can easily happen again if proper measures aren't taken.
