Commentary by Attorney Michael Grossman
When a crash involves a suspected drunk driver, it’s important to ask: Where did they get their alcohol, and was it served responsibly?
Right now, authorities believe alcohol may have been a factor in this wreck, but that’s usually where police investigations stop, in my experience. More often than not, little effort is made to determine where the driver was drinking and whether a bar or restaurant may have contributed to the crash by overserving them.
Texas dram shop law exists to hold alcohol providers accountable when they serve obviously intoxicated patrons who then cause harm. If further investigation confirms that alcohol played a role here, it’s critical to ask whether the driver was drinking at a licensed establishment and, if so, whether that business followed the law.
Determining where the alcohol came from isn’t just about getting answers for those affected by the crash. It’s also about making sure alcohol providers follow the law to help prevent similar wrecks in the future.
