Commentary by Attorney Michael Grossman
When a vehicle suddenly leaves the roadway and overturns, the question isn’t just what happened in those final moments but what caused the driver to lose control in the first place. Without digging deeper, important details about the chain of events may remain hidden.
1. Did the authorities thoroughly investigate the crash?
It’s not clear whether investigators reconstructed the pickup’s path or simply documented the scene. To understand this kind of crash, investigators need to measure skid or yaw marks, analyze the steering inputs that may have occurred, and consider whether the driver was facing fatigue, distraction, or even a medical issue. Unfortunately, single-vehicle crashes often get less investigative effort, even though their causes can be just as complex as multi-vehicle collisions.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
A loss of control with no clear reason should always raise the question of mechanical failure. A sudden tire blowout, steering malfunction, or brake problem could have made the truck impossible to manage. Pickup trucks, with their higher center of gravity, are also more prone to overturning when stability is lost. Unless the vehicle was inspected by a qualified professional immediately after the crash, signs of a defect may already have been overlooked.
3. Has all the electronic data relating to the crash been collected?
Modern pickups often have event data recorders that store details such as speed, steering angle, and braking in the seconds before a crash. That information could show whether the driver attempted corrective action or if the truck behaved unexpectedly. Investigators should also review GPS data, nearby cameras, and phone activity to build a fuller picture of the driver’s actions and the vehicle’s movement.
When the explanation isn’t obvious, it’s all the more important to look beyond the surface. A thorough investigation is the only way to move from speculation to answers.
Key takeaways:
- Single-vehicle rollovers require detailed reconstruction to explain the loss of control.
- Mechanical problems, particularly in pickups, can make a vehicle unstable without warning.
- Electronic and digital data may hold the clearest record of what actually happened.
