Commentary by Attorney Michael Grossman
If everything in these preliminary reports is true, there needs to be a serious investigation not just into what happened but why it happened. Simply put, if a trained professional truck driver is at a light, and they want to turn through a crosswalk, they should be able to do so without overlooking any pedestrians around their vehicle or in the crosswalk. So what was different about this driver?
Was the driver distracted and on their phone? Were they a new, poorly trained driver? Does their truck not have any blind spot equipment? Does the driver have a history of reckless driving or accidents? Was their employer rushing them to meet an unreasonable deadline? Were they fatigued due to long hours?
I ask these questions because I too often see authorities begin and end their investigations at an accident scene. But even if authorities find that this truck driver was in the wrong, and even if they issue citations or file charges, that might not be the end of the story. There could be deeper issues that, if left unchecked, could continue to put lives at risk.
I've handled hundreds of commercial vehicle accident cases. Families don't just want some "bad guy" to blame. They want accountability. Whether this all was just some unavoidable accident, the actions of a single reckless driver, or the inevitable result of a negligent work culture leading to someone getting killed, it's important to know the whole story of what led to the accident. That way, any and all parties responsible for someone senselessly losing their life can answer for their actions.
