Commentary by Attorney Michael Grossman
Crashes that leave multiple people hurt often prompt hard questions, ones that go beyond what’s obvious at the scene. When a vehicle rolls over or leaves the road, it's tempting to assume the situation is cut and dry. But that mindset can easily overlook critical pieces of the puzzle.
Did the authorities thoroughly investigate the crash? With a vehicle flipping after hitting a guardrail, the path it took before the impact becomes key. The question is whether investigators carefully reconstructed that path. Did they map the scene in detail, trace tire marks or evaluate driver inputs in the moments leading up to the crash? It’s worth remembering that not all departments bring the same level of skill or resources to these investigations. Some officers have advanced training in crash dynamics, while others may rely mostly on surface-level observations.
Has anyone looked into the possibility that a vehicle defect caused the crash? A heavy-duty pickup like the one involved carries a lot of weight; and sometimes, underlying mechanical issues can have serious consequences. Problems like brake line failures, steering issues or even an overloaded bed can lead to loss of control. Especially when a crash results in a rollover, it’s critical to question whether a mechanical failure contributed, even if it’s not immediately visible.
Has all the electronic data relating to the crash been collected? Modern trucks are often loaded with digital information, from onboard event data to phone records and GPS trails. That kind of data can show whether the driver braked, swerved or accelerated before hitting the guardrail. Without pulling that information, conclusions about what really happened will always rest on shaky ground.
As with many crashes, this one leaves more questions than answers at first glance. Digging deeper isn’t just a technical exercise; it’s the only way to make sure all the facts come to light, especially when serious injuries are involved.
Key Takeaways:
- Not all crash investigations go deep enough to explain what really happened.
- A truck's mechanical condition should never be assumed to be fine without inspection.
- Electronic data can reveal the full story, but only if someone knows to look for it.
