Commentary by Attorney Michael Grossman
When a teenager crashes into a traffic signal pole late at night, it's easy to jump to conclusions—speed, distraction, or fatigue. But in any serious crash involving a young driver, those assumptions need to give way to questions rooted in evidence. The real cause isn’t always what it seems.
Did the authorities thoroughly investigate the crash?
Collisions near intersections raise important questions about how the vehicle approached and whether the driver reacted to something unexpected. Did investigators measure skid marks or steering angles? Was there any indication of a last-minute maneuver to avoid another car, pedestrian, or object? These kinds of details can help determine whether the driver lost control—or if they were responding to something in the road. A basic accident report alone doesn’t provide that depth.
Has anyone looked into the possibility that a vehicle defect caused the crash?
For a vehicle to leave its lane and strike a fixed object like a pole, it’s critical to ask whether a malfunction played a role. Could the Chrysler’s steering, brakes, or suspension have failed? Was there a tire blowout or an issue with stability control? Without a hands-on inspection, these questions often go unasked—especially in single-vehicle crashes where blame is easy to assign without evidence.
Has all the electronic data relating to the crash been collected?
The Chrysler 200 likely contains an event data recorder that could confirm whether the driver was braking, accelerating, or steering in the seconds before the crash. That kind of information can help distinguish between driver misjudgment and a vehicle that failed to respond to input. GPS and onboard sensors may also add insight into vehicle movement and timing.
Late-night crashes involving young drivers should never be treated as open-and-shut cases. The causes are often more complex, and the answers lie in the evidence that’s easiest to overlook.
- Intersection crashes should be reconstructed to determine vehicle path and driver response.
- Mechanical failures—especially in steering or braking—must be ruled out with inspection.
- Vehicle data can confirm what the driver did and whether the vehicle responded correctly.
