Commentary by Attorney Michael Grossman
With any fatal work accident, people often think OSHA does their thing, families are guaranteed a resolution, and that's that. In reality, OSHA is often just the tip of the iceberg, and there isn't always a guaranteed path toward a resolution.
Texas has the most complex work fatality laws of any other state in the country. Sometimes, a worker's family has to fight for their benefits, and that usually means having it out with an employer whose number one priority is to avoid responsibility. OSHA doesn't work to help families navigate that legal maze. Their focus is on looking for citations and fines to issue. Beyond that, families are typically on their own.
So as concerning as an OSHA summary like this is, it may just be a small piece of the larger puzzle. That's why a lot of families seek out experienced professionals who understand Texas work fatality laws and know how to navigate them. That way, they can be sure there's a clear path to getting them the resolution they deserve.
