Commentary by Attorney Michael Grossman
If the reports here are accurate, then the details may seem pretty open-and-shut. Authorities say a semi failed to control speed and caused a crash. What more is there to tell? Well, it's important to know why that happened if there's actually going to be full accountability. Let me explain why.
I've handled hundreds of commercial vehicle accident cases. A lot of the time when a truck driver makes a mistake, it's because there were issues behind the scenes setting the stage for that mistake to happen. For example, the driver's employer might pressure them to meet unreasonable deadlines. They could be forcing drivers to work long hours. They could be moving overweight cargo or running on worn brakes or tires. The driver might be inexperienced and poorly trained. They could have a history of reckless driving that the employer ignored or failed to weed out during the hiring process.
When these conditions exist, they will inevitably lead to harm. If accountability merely begins and ends at the crash scene, those conditions can continue to put lives at risk. So while it's possible this all happened due to an isolated mistake, it's important to let the evidence say for certain one way or the other. Victims and families deserve to know that all parties who wronged them will face appropriate consequences. That requires a much more thorough investigation than what's been made public here so far.
