Commentary by Attorney Michael Grossman
When people see an alleged drunk driver involved in an accident, they tend to assume that authorities file their charges, and that's that. However, there's often an accomplice to these accidents who also needs to be held accountable. To that end, have authorities looked into where the driver got their alcohol from? It's possible there's a negligent alcohol provider who is also responsible for the accident.
In short, it's unlawful in Texas for alcohol providers to serve patrons who are obviously intoxicated. If they do so, they can be held responsible if that person's intoxication leads to people getting hurt. This can both provide an opportunity for victims and families to ensure there's accountability for those who wronged them as well as to get an otherwise reckless establishment to clean up their act before more people get hurt.
Unfortunately, a lot of these negligent establishments fly under the radar. I've handled hundreds of cases involving alleged drunk drivers. I can't begin to count how many times authorities simply moved on after investigating the crash scene. Meanwhile, there were alcohol providers responsible for contributing to those accidents who only faced consequences because the victims and families wanted a second set of eyes looking things over. I can't say how thorough authorities here have been, but it wouldn't surprise me if there was still more to this story that needed further investigation.
