Commentary by Attorney Michael Grossman
When people hear about crashes like this one, it’s easy for them to assume they are a result of simple driver error. However, in my experience, accidents involving large trucks often require thorough investigations to understand all contributing factors.
In this case, it is crucial to determine why the tow truck veered off the freeway and onto the shoulder. Factors such as mechanical failure, driver fatigue, or even distracted driving should be considered. Each of these elements can significantly impact a driver’s ability to maintain control of their vehicle, especially on a busy highway.
The circumstances surrounding this accident highlight the importance of ensuring the safety of roadside workers. This incident underscores the dangers faced by those who work along highways. Investigators will need to closely examine whether the tow truck driver adhered to traffic regulations and maintained an appropriate level of attention to the road.
Additionally, the condition and maintenance of the tow truck will be a focus of the investigation. Regular inspections and proper upkeep are essential for ensuring that commercial vehicles operate safely. Any lapses in this area could indicate negligence on the part of the tow truck company or the driver.
The company responsible for the tow truck may also share responsibility for the accident. If the company failed to enforce safety protocols, properly train their drivers, or ensure that their vehicles were in good working order, they could be held accountable for their role in the crash.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it is crucial to consider every factor to ensure that those impacted by the crash receive the clarity and closure they deserve.
