Commentary by Attorney Michael Grossman
People rightfully call for there to be consequences for alleged intoxicated drivers. The problem is when investigations begin and end there. That's because there may be an accomplice who also needs to be held accountable: a negligent alcohol provider. Here's why that's important.
Texas dram shop laws prohibit bars, restaurants, and other alcohol providers from serving alcohol to someone who is obviously intoxicated. If the driver in this crash had been drinking at an establishment that ignored clear signs of impairment, that business may share responsibility for what happened.
So if alcohol was a factor here, it's important to know if authorities are continuing their investigations to cover all possible factors. Victims and families deserve to know there will be accountability for all parties whose unlawful actions harmed them.
