Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope the injured driver receives a full recovery and the answers he needs. A single-vehicle collision that involves veering off the roadway, striking multiple fixed objects and ultimately landing in a creek suggests that something went seriously wrong, possibly beyond just driver error. While the report provides a general description of what happened, it leaves out critical context. To fully understand what happened on U.S. Route 67 near Blanket, we need to ask three essential questions.
First, did the authorities thoroughly investigate the crash? When a vehicle departs the roadway in this manner, a detailed scene investigation is necessary. What were the weather and road conditions at the time? Were there signs of a mechanical issue or an evasive maneuver to avoid another vehicle, animal or obstacle? Were there any skid marks, debris trails or tire blowouts that might offer insight into the cause? Understanding whether the departure from the road was due to an outside factor, distraction or something more mechanical requires careful scene documentation and analysis.
Second, has anyone considered whether a vehicle defect might have contributed to the crash? The 2021 Nissan Rogue should be preserved and examined for signs of mechanical or electronic failure. Was there a problem with the steering, brakes or electronic stability control? Did the throttle stick or was there an issue with a tire or suspension component? Many modern vehicles have advanced driver-assist features. Did any of those systems malfunction or misinterpret the roadway? These questions can only be answered with a thorough mechanical and diagnostic inspection of the vehicle, which must be done before it is repaired or discarded.
Finally, has all the electronic data related to the crash been collected? The Rogue’s engine control module likely holds pre-crash data, including speed, throttle position, brake application and steering inputs. That information can help determine whether the driver was in control and attempting to correct course, or whether something went wrong internally. If the driver had a phone or wearable device, that could offer GPS data or movement tracking that contributes to reconstructing the moments before the crash. All of this evidence is time-sensitive and must be preserved before it is lost.
Crashes like this deserve a comprehensive and fact-based investigation. A man suffered serious injuries, and while the cause might seem straightforward on the surface, assumptions are not enough. Only by asking the right questions, preserving the vehicle and analyzing all available data can we determine what truly happened, and ensure that anyone affected has the clarity they deserve.
