Commentary by Attorney Michael Grossman
Single-vehicle crashes may seem simple, but they often require deeper investigation to uncover what truly happened. If authorities are too hasty or unmotivated to get answers, important details might slip through the cracks. It can be helpful, then, to ask some key questions and gauge the quality of their efforts.
The first question is whether authorities had the tools and time to investigate thoroughly. Did they examine road conditions, document tire marks, or consider hazards that might have caused the vehicle to leave the road?
The second question is whether a vehicle defect played a role. Brake failures, tire blowouts, or faulty safety systems like seatbelts or airbags can lead to or worsen a crash. A forensic inspection of the vehicle is critical to identify these issues.
Finally, was all electronic evidence secured? Engine Control Modules (ECMs) store vital data, and cellphone or GPS records may clarify what happened. Collecting this evidence quickly ensures nothing is lost.
Asking these questions can help reveal authorities have been too narrow in the scope of their investigators or more focused on throwing blame around than actually hearing out the victim's side of the story. Anytime their efforts seem to be falling short, it gives victims and families an opportunity to have a secondary investigation pick up the slack.
