Commentary by Attorney Michael Grossman
When a crash results in critical injuries, especially involving a young driver, it’s essential that investigators move beyond assumptions about right-of-way and examine all potential contributing factors. To do that properly, three key questions must guide the process: (1) Did the authorities conduct a thorough and complete investigation? (2) Has anyone looked into whether a vehicle defect or mechanical failure contributed to the crash? (3) Has all electronic data from the vehicles involved been collected and reviewed?
While the initial report indicates a failure to yield, it’s important to understand why that happened. Investigators should assess the visibility at the intersection—were there obstructions, poor lighting, or signage issues that may have interfered with the driver’s view or judgment? The configuration of the road, speed limits, and signal timing should all be considered as part of a proper scene reconstruction.
The Jeep Cherokee also deserves a detailed mechanical inspection. If there was a problem with the brakes, steering, or throttle control, the driver may not have been able to respond appropriately—even if she saw the other vehicle. The condition of the tires, suspension, and any known recall issues should be evaluated, particularly in cases involving newer or teen drivers who may not be aware of underlying maintenance needs.
Electronic control module (ECM) data from both the Jeep and the Ford pickup could provide vital insight. This information can show vehicle speed, braking activity, steering input, and throttle position leading up to the crash. It may also confirm whether the Jeep attempted to stop or swerve and whether the systems responded properly. Retrieving and preserving this data early in the investigation is crucial.
Until these areas are fully explored—roadway conditions, vehicle systems, and digital crash data—the full cause of the incident remains uncertain. A comprehensive investigation is necessary to understand what led to this crash and whether any factors could be addressed to help prevent similar outcomes in the future.
