Commentary by Attorney Michael Grossman
After a serious crash, folks tend to think that it's best to just wait for authorities to get all of the facts. Unfortunately, authorities are not always reliable when it comes to getting answers after a serious accident. They have many other responsibilities, and sometimes that leads to details slipping through the cracks. A few key questions can help bring these potential shortcomings to light.
Did investigators take the time and use the right tools to fully analyze the crash? Multi-vehicle accidents can be chaotic, and if authorities are focused more on clearing the scene than gathering evidence, important details—like vehicle positioning, road conditions, or driver actions—may go unexamined. Were they thorough in reconstructing the sequence of events?
Did they consider whether a vehicle defect played a role? Mechanical failures—such as brake malfunctions, steering issues, or acceleration problems—could have contributed to the initial collision or prevented drivers from avoiding it. Additionally, if seatbelts or airbags failed, injuries may have been worse than they should have been. Were the involved vehicles carefully inspected before crucial evidence was lost?
Did they secure all available electronic evidence? The vehicles’ Engine Control Modules (ECMs) may contain key data on speed, braking, and steering inputs before impact. GPS records, cellphone activity, and nearby surveillance or traffic camera footage could provide further insight into what happened. Did authorities take steps to preserve this information before it was lost?
Sometimes, authorities have clear, convincing answers, and that's a sign they did good investigations. Other times, their efforts come up short, and victims and families involved in the accident can take steps to have a second set of eyes look things over.
