Commentary by Attorney Michael Grossman
When a vehicle crosses over into the opposite lane of a major highway and causes a fatal collision, the assumption is often that the driver simply lost control. But that explanation—while convenient—is rarely complete. In order to understand what truly happened, especially in a high-speed, high-impact environment like Interstate 94, a proper investigation must begin by addressing three critical questions.
First, did authorities conduct a thorough investigation at the crash scene? When a vehicle veers across lanes of traffic, it’s essential to examine the full context—roadway conditions, surface integrity, visibility, traffic volume, and potential obstructions. Investigators should assess whether the truck’s departure from its lane was gradual or sudden, and whether there were any signs of evasive action. Skid marks, yaw patterns, and vehicle positioning can help reconstruct whether this was the result of driver input, an environmental factor, or something else entirely.
Second, has anyone explored the possibility of a mechanical or electronic failure within the vehicle? Crashes that appear to involve loss of control may actually be rooted in failures of critical systems like steering, brakes, or electronic stability control. A malfunction in any of these components—especially at highway speeds—can cause a vehicle to respond unpredictably or become uncontrollable. Additionally, when a crash results in a fatality, the performance of the truck’s restraint systems and structural integrity should also be reviewed to assess whether the vehicle protected its occupant as intended.
Third, has all available electronic data from the vehicle been retrieved and analyzed? Most pickup trucks are equipped with electronic control modules (ECMs) that store detailed information about how the vehicle was operating in the seconds before a crash. This includes speed, throttle position, braking, steering input, and more. That data can often provide the clearest picture of what the driver was doing and how the vehicle was responding. In addition, investigators should look for external sources of evidence, such as traffic cameras, nearby surveillance systems, or dash cam footage, which may help confirm or expand on the electronic data.
A fatal crash on a highway is never just about what can be seen at the scene. It’s about understanding every factor that may have contributed—whether related to the driver, the environment, or the machine itself. These three questions form the foundation of that process, ensuring that the investigation doesn't stop at assumptions but digs deeper into the facts. For those affected, finding those answers is a necessary step toward resolution and clarity.
