Commentary by Attorney Michael Grossman
Authorities did not say where this truck was, why it was unoccupied, or whether or not it was clearly visible or reasonably avoidable. That matters. There's a big difference between, for example, a car running off-road and hitting a truck parked in a driveway, and a car hitting a disabled truck that was left on the side of a dark, narrow highway without any flares or lights. In other words, there's likely a lot more to this story than the public statements suggest, and there are vastly different possibilities to consider.
