Commentary by Attorney Michael Grossman
A commercial truck running into oncoming traffic is obviously a serious issue, and it brings up all kinds of possible factors—many of which could be signs of severe negligence. However, it's important for investigators to be as thorough as possible so that uncommon or easy-to-miss factors don't slip through the cracks.
Did the truck have a tire blowout? Did the driver fall asleep? Was there a sudden cargo shift? Was the truck being adequately maintained? Is the truck driver properly trained and experienced? Do they have a history of reckless behavior? Were they rushing to meet an unreasonable deadline? Have authorities pulled cellphone records and data from the vehicles involved? Has the nearby area been canvased for any potential cameras that may have caught the incident on video? Was the roadway inspected for flaws or hazards?
These are just some of the questions that I can generally count on independent accident reconstructionists to answer. That helps to ensure that whether someone did something wrong or the event was just an unavoidable accident, the victims and families involved can at least be sure they're getting the whole story. If authorities here are asking those same questions, that's a good sign. But if they're not digging beyond surface-level details, they might miss something crucial.
