Commentary by Attorney Michael Grossman
As few details are available right now, any work fatality in Texas is likely to present unique challenges for the victim's family. This is because benefits for a worker's loved ones are not always guaranteed. Employers in Texas are not required to subscribe to the workers' comp system, which means families sometimes have to put together evidence and legal tools to make sure they can work toward a resolution that's fair and that meets their needs as best as possible.
This is why I always caution against just waiting around for authorities to handle a fatal work accident. Their priorities and those of a family who lost a loved one to a workplace accident are not always going to align. Being able to independently show what happened in the accident and how it could have been avoided can help protect families from being left at the mercy of the shortcomings of authorities or the self-centered priorities of an employer.
