Commentary by Attorney Michael Grossman
When a car crosses into oncoming lanes and causes a head-on collision, the aftermath often leaves more questions than answers. Without clear indicators at the scene, it’s easy to fall back on broad assumptions—but the real story is rarely that simple.
1. Was the crash investigated with the depth it required?
A crossover collision like this demands a detailed reconstruction. Investigators should be asking: Was there any steering input before the Nissan crossed over? Was speed a factor? Did either driver attempt to brake or swerve? Getting those answers requires mapping the path of both vehicles, reviewing roadway evidence, and examining vehicle positions—not just documenting the final resting point. Without that kind of analysis, the causes remain murky.
2. Could a mechanical failure have triggered the crossover?
Cars don’t drift into opposing lanes without something changing. A steering malfunction, tire blowout, or brake failure could all cause a sudden loss of control. Was the Nissan checked for signs of mechanical breakdown? Did it have any recent repairs or warning lights that went unaddressed? Unless someone conducted a post-crash inspection, these possibilities may never be considered.
3. Has digital evidence been reviewed for both vehicles?
Onboard systems could reveal a lot—speed, braking, steering angle, and even whether the driver took evasive action. Paired with GPS data or phone records, investigators can build a clearer picture of what led up to the impact. Traffic cameras or nearby surveillance footage could also confirm road behavior in the moments before the crash. The question is whether anyone has pursued that data.
When serious injuries and fatalities are involved, the investigation has to dig deeper than surface-level explanations. It’s not just about knowing what happened—it’s about making sure all the right questions get asked while the answers are still available.
Takeaways:
- Head-on crashes need full scene reconstructions, not just documentation of the outcome.
- Mechanical problems like steering or tire issues should be ruled out with an inspection.
- Electronic data and nearby footage can shed light on vehicle behavior before the collision.
