Commentary by Attorney Michael Grossman
When people read about a rear-end collision, they jump to the old misconception that the rear driver is automatically to blame. That's not really true.
I recall a crash a while back, for example, where preliminary statements said a father and their kid died after rear-ending an 18-wheeler on a dark highway. In the ensuing weeks, people just assumed the dad was speeding or on his phone. However, new details came to light explaining the 18-wheeler pulled off of the shoulder without its lights on.
Who in their right mind would hold the rear driver responsible for something like that? The law certainly doesn't. It's nuanced enough to consider why the collision happened and whether or not it could have been avoided. Did authorities look into this thoroughly enough to make those injuries clear?
