Commentary by Attorney Michael Grossman
Parking lot accidents are often written off as low-speed mishaps, but the reality is they can be just as deadly as those on open roads. When someone on foot is struck and pinned by a moving vehicle, it raises serious questions about what led to such a devastating outcome.
1. Did the authorities thoroughly investigate the crash?
In situations like this—especially when someone is killed—investigators need to go beyond the basics. Did they diagram the scene, collect surveillance footage from nearby businesses, and document tire marks or the position of the vehicle in detail? Just because it happened in a parking lot doesn’t mean it’s any less important to reconstruct. Unfortunately, many local agencies treat these incidents more like paperwork than like potential criminal or civil cases, and that can leave major gaps in understanding.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
When a car unexpectedly accelerates and pins someone against a structure, it’s fair to ask whether something went wrong inside the vehicle. Was there a stuck pedal? A malfunction in the throttle system? Driver error is always a possibility, but the only way to be sure is to inspect the Civic’s mechanical and electronic systems. Without that, it's impossible to rule out whether the vehicle itself played a role.
3. Has all the electronic data relating to the crash been collected?
Modern vehicles like the Civic are equipped to tell their side of the story. Data from the vehicle’s event recorder could show whether the accelerator was pressed, how much force was applied, and whether the brakes were ever engaged. In a case involving a sudden and deadly movement, that kind of information is vital. Investigators should also consider whether surveillance footage or mobile phone data could offer context that goes beyond what witnesses recall.
What happened here may seem like a fluke, but unexplained incidents are often where hidden causes live. Until someone asks the right questions and pulls the right data, there’s no way to know whether this was purely human error or something deeper.
Takeaways:
- Parking lot fatalities still demand detailed investigation and scene documentation.
- Sudden acceleration could point to a mechanical issue, not just a driver mistake.
- Vehicle data can reveal what the car was doing in the moments before the crash.
