Commentary by Attorney Michael Grossman
As open-and-shut as this all may seem, there's the old saying that it's not about what you know; it's about what you can prove. That's why having someone to blame is rarely the end of the story after a serious car accident. Victims and families still need convincing evidence telling their side of the story. Insurance companies take any opportunity they can find to muddy the waters, and gaps in the facts act as footholds for them to do so. The fewer gaps there are to exploit, the better the outcomes victims and families will generally have. I see no reason right now why this crash would be an exception to that.
