Commentary by Attorney Michael Grossman
Single-vehicle motorcycle crashes often get treated as self-explanatory—just the rider, the road, and a mistake. But that kind of thinking can leave out critical pieces of the puzzle. Especially in late-night incidents, it's worth asking whether something else was at play beyond what’s immediately visible.
Did the authorities thoroughly investigate the crash?
When there's no second vehicle involved, investigations can be surprisingly brief. But that doesn’t mean they should be. Did officers reconstruct the rider’s path leading up to the crash? Was speed evaluated in a meaningful way? Did they consider whether the rider was forced to react to something off-camera or out of sight? Without a full scene analysis and a careful look at what the motorcycle was doing before the crash, big questions can go unanswered.
Has anyone looked into the possibility that a vehicle defect caused the crash?
When a motorcycle goes down without obvious cause, mechanical failure should always be on the table. Was there a brake lock-up? A tire blowout? Did the throttle stick or the handlebars shake uncontrollably? Even a small defect in steering, suspension, or electronics can cause a rider to lose control—especially at highway speeds. Unless someone inspects the bike closely, those kinds of issues often go unnoticed.
Has all the electronic data relating to the crash been collected?
Many modern motorcycles store limited—but valuable—data about how they were operating before a crash. If the Harley was equipped with a system that logged speed, lean angle, or sudden deceleration, that could help explain what happened. GPS data or ride-tracking apps might also reveal more about the rider’s speed, route, or behavior leading up to the incident. Without that digital trail, conclusions end up based solely on what’s left at the roadside.
When the facts seem simple, that’s when it’s most important to question them. Behind every single-vehicle crash, there’s often more to the story than the initial reports suggest.
Takeaways:
- Even single-vehicle motorcycle crashes should involve full scene analysis and vehicle path review.
- Mechanical failures like brake or tire issues can cause crashes without leaving obvious signs.
- Onboard and GPS data may hold key clues about what happened in the moments before the wreck.
