Commentary by Attorney Michael Grossman
When a motorcycle and a larger vehicle collide, the imbalance in size and protection often leaves the rider most severely injured. But beyond the outcome, the key question remains: what led to these two vehicles crossing paths in the first place?
1. Did the authorities thoroughly investigate the crash?
Right now, the cause hasn’t been made clear, and it’s unknown how deeply investigators have examined the sequence of events. For crashes like this, they should be looking at lane positions, points of impact, and whether either driver attempted evasive maneuvers. Skid marks, debris patterns, and sightlines all help reconstruct what actually happened. Without that level of detail, important context could be missed.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
When a collision involves sudden movement or loss of control, mechanical failure has to be considered. For the motorcycle, a brake or tire issue could have made it harder to stop or steer away. For the Dodge Durango, problems with brakes, steering, or electronic safety systems could also have contributed. Unless both vehicles are carefully inspected, the role of a defect may never be fully addressed.
3. Has all the electronic data relating to the crash been collected?
The Durango likely contains an event data recorder that could show speed, braking, and steering input leading up to the crash. The motorcycle may have more limited electronic data, but GPS or aftermarket systems sometimes provide useful records. Investigators should also check for nearby surveillance cameras, dashcams, or phone records, which can offer vital insight into what both drivers were doing in the seconds before impact.
Collisions between motorcycles and larger vehicles often get reduced to simple explanations, but the truth is usually more complex. Careful attention to evidence is the only way to move past assumptions and find answers grounded in fact.
Key takeaways:
- Reconstruction should focus on lane position, driver actions, and impact points.
- Both the motorcycle and SUV could have been affected by mechanical problems.
- Vehicle data, cameras, and phone records may clarify what really happened.
