Commentary by Attorney Michael Grossman
A lot of people see that an alleged drunk driver was recommended to face charges, and they think that's the beginning and end of the story. For authorities, it often is. But with more thorough investigations, details may show there was an accomplice who also needs to be held responsible: an alcohol provider.
Texas law says alcohol providers such as bars or restaurants can be responsible if they over-serve someone who is obviously intoxicated. If they do so, they can potentially face criminal investigations, fines, suspended licenses, or liability for resulting injuries.
I can't count how many times victims and families came to us after a serious accident, we found a negligent alcohol provider involved, and authorities were nowhere to be found. It's possible authorities have been more thorough here, but that's not something to take for granted.
