Commentary by Attorney Michael Grossman
Having been in this line of work for over 30 years, the same old misconception I have people ask me about is if someone is automatically responsible for rear-ending another vehicle. Simply put, there is no automatic fault like that. Context matters, and it's important there are thorough investigations to determine the exact circumstances leading up to the accident.
For example, there was a crash some time ago where initial reports said a father and son were killed after rear-ending an 18-wheeler on a dark highway. It took weeks for authorities to find out that the 18-wheeler actually merged off the shoulder without turning its lights on. No reasonable person would blame someone for hitting a massive commercial vehicle they couldn't even see. The law wouldn't, either.
So while it's not clear what exactly led to this crash, it would be downright disrespectful to immediately blame anyone. There needs to be an accounting of the facts, and that needs to include even unusual possible circumstances, such as potential vehicle defects or road design issues. If nothing else, the victims' loved ones deserve answers.
