Commentary by Attorney Michael Grossman
After any fatal truck wreck, it's important to know that the investigations are being handled properly. There are some officers who may only ever see one or two fatal truck wrecks in their whole career. On top of that, the crash may require time and equipment a department may not be able to provide. It's one of the reasons independent accident reconstructionists are so crucial for victims and families involved in a serious truck wreck.
Having handled hundreds of commercial vehicle accident cases, I know the sorts of factors a proper accident reconstruction should touch on. Road conditions, vehicle defects, maintenance records, Engine Control Module (ECM) data, phone records, hiring practices, safety procedures, hours of service logs, cargo shifts, dash cameras and cameras inside a truck driver's cabin, etc. These are all important to consider, even if the end result is that something has been ruled out.
Generally speaking, if authorities can show they're able to cover all of these important factors, then an independent investigation may simply confirm what authorities already know. However, if it seems authorities might not have the resources to do things right, it may mean that a more thorough independent investigation is necessary to pick up the slack and ensure those involved in the crash get the answers they deserve.
