Commentary by Attorney Michael Grossman
When someone is seriously injured in a single-vehicle accident and few details are available, it’s easy to assume the crash was simply the result of a driving error. But in my experience, those assumptions often come at the cost of meaningful answers. Even when only one vehicle is involved, there are three critical questions that should be asked to help understand what really happened.
First, did the authorities thoroughly investigate the crash? A proper investigation should go beyond documenting the location of the wreck. It should include an analysis of roadway design, skid marks, visibility conditions, and potential obstructions. Unfortunately, the level of detail in these investigations often depends on the resources and training available to the responding agency, which can vary significantly.
Second, has anyone examined whether a vehicle defect could have contributed to the incident? Issues with steering, tires, brakes, or even onboard safety systems can cause a driver to lose control without warning. Unless someone makes the effort to preserve and inspect the vehicle soon after the crash, any opportunity to detect a mechanical failure may be lost.
Finally, has all the electronic data from the vehicle been collected? Many modern vehicles record key information in the moments leading up to a crash—speed, brake application, and steering inputs. That data can be essential in showing whether the vehicle responded appropriately to the driver's actions, or whether something went wrong behind the scenes.
Understanding how and why a crash happened is essential—especially when someone has been seriously hurt. The answers don’t always come easily, but they can’t be found unless the right questions are pursued from the start. Asking these questions is the least that can be done to ensure that those affected by this crash get the clarity and closure they deserve.
