Commentary by Attorney Michael Grossman
When a vehicle overturns on a city street in the middle of the night, and the driver ends up seriously hurt, the focus tends to be on what the driver might have done wrong. But that doesn’t tell the whole story. A crash like this raises questions that need answers—starting with whether the vehicle gave the driver a chance to avoid it.
Did the authorities thoroughly investigate the crash?
An early-morning rollover on a straight urban roadway is unusual and should trigger a thorough reconstruction. Did officers document the car’s trajectory, look for signs of overcorrection, or estimate speed based on the damage and debris? Was the rollover caused by a sudden evasive maneuver—or did something else force the vehicle off balance? If the investigation skipped these basic steps, then there’s a real risk that the cause will remain unclear.
Has anyone looked into the possibility that a vehicle defect caused the crash?
A Honda Accord isn't the kind of vehicle you expect to see flipped unless something went seriously wrong. A suspension failure, steering issue, or even a tire blowout could cause a sudden shift in balance and lead to a rollover—especially if the driver tried to correct or brake. Electronic stability control and other safety systems are designed to prevent exactly this kind of crash, but they don't always work as intended. If no one inspected the car thoroughly, those issues could go completely unnoticed.
Has all the electronic data relating to the crash been collected?
If the Accord was a recent model, it likely holds event data that shows what the car was doing just before it flipped—speed, throttle position, brake input, and steering angle. That information can help confirm whether the driver attempted to avoid something, or if the car veered on its own. GPS data or phone activity could also provide context, but it has to be retrieved quickly before it’s lost or overwritten.
Even a single-car crash in the early morning hours can reveal a lot—if someone takes the time to look closely. Without a deeper investigation, the real cause may never come to light.
Takeaways:
- Rollover crashes on city streets require full reconstruction to understand what caused the vehicle to tip.
- Mechanical or electronic failures—especially in suspension, steering, or stability systems—must be ruled out.
- Vehicle telemetry can confirm whether the driver responded—and if the car responded appropriately.
