Commentary by Attorney Michael Grossman
With motorcycle wrecks, my concern is whether or not investigations were as thorough as they should've been. A lot of people have a negative bias against motrocyclists, and I've seen this result in incomplete or inaccurate crash reports. Sometimes, following up with authorities can shine a light on this.
One question, for example, is whether investigators had the time, tools, and expertise to fully analyze the crash. Motorcycle accidents, especially those involving a collision with another vehicle, often require detailed documentation of tire marks, debris, and points of impact. Did authorities evaluate the scene for road hazards, visibility issues, or other environmental factors that might have contributed? Without a comprehensive investigation, key details can easily slip through the cracks.
Second, could a vehicle defect have played a role? Mechanical failures, such as brake or throttle issues on the motorcycle, or even problems with the car—like brake lights not functioning—can significantly affect how events unfold. Safety systems also need to be evaluated to determine if they performed as intended. A forensic inspection of both vehicles is essential to rule out any defects that might have contributed to the crash or its severity.
Finally, was electronic evidence collected and reviewed? This can include things like cellphone records, GPS data, or nearby video footage could help clarify how the collision occurred. Ensuring this evidence is preserved quickly is critical for a thorough investigation, as it may be deleted or overwritten after a period of time.
If authorities are able to provide clear and convincing responses to these concerns, it's likely a sign their investigations were thorough. Otherwise, if they can't provide satisfactory answers, it may be a sign they had trouble setting aside their bias and letting the evidence speak for itself.
