Commentary by Attorney Michael Grossman
With charges being recently reported, it's important not to write this all off as open-and-shut. Even if the truck driver faces charges, commercial vehicle accidents also involve employers who can contribute to the situation through their own actions—or lack thereof. As such, it's important to know if authorities are looking into both potential culprits to determine not just what happened here but why. Let me explain.
I've handled hundreds of commercial vehicle accident cases. A lot of the time, they're not just the result of an individual driver's isolated mistake. There is often a pattern of behavior that made the accident inevitable. For example, the truck driver may have been working long hours due to an unreasonable schedule. The company may have hired an inexperienced driver or one with a history of reckless behavior because they failed to do proper background checks. Intoxicants could have played a role that regular testing and supervision could have caught.
It's obviously important to hold a reckless driver accountable for a deadly truck wreck their actions caused. However, if there is an opportunity to help prevent other families from suffering similar harms, that's important, too. The families I've worked with were just as keen to see someone face consequences as they were to make sure no other family went through the hardships they did. If authorities aren't investigating these events thoroughly enough to provide that kind of closure, then there may need to be secondary investigations picking up the slack.
