Commentary by Attorney Michael Grossman
After any serious car accident, it's important to verify how the investigations have been handled. People often take for granted that authorities turn over every stone and look into all possible factors. The reality is a lot of car accidents need further independent investigations to really get the full story. That's why I always consider some key questions early on.
- Did authorities have the time and tools needed for a proper accident reconstruction?
Sometimes, authorities are forced to move on too quickly or are left without proper equipment to dig into complex factors and preserve evidence. That can lead to oversights and mistakes. - Have authorities inspected the vehicles for defects?
Likely or not, vehicle defects can lead to serious accidents or otherwise cause serious injuries which could have been avoided. Steering, brakes, tires, airbags, seatbelts, lane assistance, automatic driving systems—it's worth looking into all of these if only to rule out something unusual. - Has all electronic data been preserved?
This includes things like vehicle data, cellphone data, GPS, and any possible cameras nearby the crash scene which may have had a view of the road. Much of this evidence can be time sensitive, so it's important to secure it promptly.
Generally speaking, if authorities can provide satisfactory answers to these questions, that's a sign they've taken the investigations seriously and should be able to provide victims and families with the answers they deserve. But if details aren't adding up, or if authorities can't provide clear answers, then that may be a sign for families to bring in more thorough independent investigators to pick up the slack.
