Commentary by Attorney Michael Grossman
When reading about incidents like this, it’s natural to ask how such a crash could occur—especially when allegations of drunk driving are involved. Authorities suggest that the driver of the Nissan Altima was intoxicated at the time of the crash, which, if true, points to a preventable set of circumstances.
One crucial question to ask in cases like this is: Where did the driver consume alcohol before getting behind the wheel? Texas law makes it illegal for bars, restaurants, or other alcohol providers to serve alcohol to someone who is obviously intoxicated. If the driver was overserved at an establishment, that business may share responsibility for the injuries caused under Texas dram shop law.
Dram shop laws are an important tool for promoting accountability and public safety. They ensure that alcohol providers take their legal responsibilities seriously and discourage reckless service that can lead to preventable crashes. Investigating where the driver had been drinking can shed light on whether any establishment violated the law and contributed to this devastating collision.
For the woman and child injured in this crash, getting the full truth about what led to this incident is essential—not just for their recovery but also to ensure that those responsible are held accountable. Accountability at all levels, from the driver to any business that may have overserved them, plays a critical role in reducing the number of alcohol-related crashes and making Texas roads safer for everyone.
