Commentary by Attorney Michael Grossman
One of the challenges with single-vehicle accidents is they're not often seen as a high priority. I've had calls from countless people who felt authorities either moved on too quickly or simply jumped to conclusions looking for someone to blame. This is one of the reasons it can be helpful to follow up with key questions to gauge if authorities are really taking the accident investigations seriously.
One of the first questions is whether investigators had the resources and time to properly document the scene. A crash at 10:28 p.m. may not have many witnesses, and low visibility can make evidence harder to spot. Important details like tire marks, impact angles, or debris patterns can quickly disappear if not followed up on promptly. If authorities lacked the tools or staffing for a thorough investigation, that could leave critical questions unanswered.
It’s also worth asking whether a mechanical issue could have played a role. A sudden failure—like malfunctioning brakes, a steering problem, or even a tire blowout—can easily cause a driver to lose control, especially on a highway. Teen drivers often get the blame in these situations, but if the vehicle isn’t closely examined, it’s impossible to rule out a defect. Preserving the car for a proper inspection is essential before it’s repaired or scrapped.
Finally, has all crash-related data been preserved? Many modern vehicles store valuable information in their engine control modules, including speed, braking, and steering input before the crash. Cell phone records or footage from nearby traffic or security cameras might also help establish what was happening in the moments leading up to the crash. If no one takes the initiative to secure that evidence early, it may be lost for good.
These questions may all result in authorities giving clear, satisfactory answers. That happens when you do good investigations. Sometimes, though, the responses leave doubts, and that's when victims and families may decide the crash needs another set of eyes looking things over.
