Commentary by Attorney Michael Grossman
When a young child is struck by a vehicle and later dies from their injuries, the immediate reaction is often one of shock and sadness. But beyond the emotions, there are critical questions that need to be asked—questions that go far deeper than who was where at the moment of impact. In any fatal pedestrian crash, especially one involving a child, three essential questions must guide the investigation: Did the authorities thoroughly investigate the crash? Has anyone considered whether a vehicle defect may have contributed? And has all the relevant electronic data been collected and preserved?
In this case, the incident took place near a neighborhood intersection during the evening hours. We don’t yet know the circumstances that led to the child being in the vehicle’s path, but that unknown is precisely why a comprehensive investigation is so important. A proper investigation should include accident reconstruction, an assessment of the driver’s line of sight, lighting conditions, possible obstructions, and the behavior of the vehicle in the moments leading up to the collision. Unfortunately, the depth and quality of these investigations can vary greatly depending on the agency involved and the resources at their disposal.
The second question—whether a vehicle defect contributed—is almost never publicly discussed in crashes like this, but it remains highly relevant. A malfunctioning braking system, faulty sensors, or limited visibility due to headlight or windshield issues could all reduce a driver’s ability to react, especially in an environment where children may be present. Determining whether any of those factors played a role requires a forensic inspection of the vehicle—something that can only happen if the vehicle is preserved before it’s altered or repaired.
The third issue is electronic data. Modern vehicles are equipped with electronic control modules (ECMs) that can record key data such as speed, braking force, and throttle position leading up to a crash. That information could provide clear insight into whether the driver was speeding, attempted to stop, or was accelerating at the time of the collision. Additional data sources like dashcam footage, surveillance video from surrounding properties, or cell phone activity may also be available—but only if someone acts quickly to secure it.
Until these three questions are fully addressed, the cause of this devastating incident remains uncertain. For the sake of the family and the community, it’s critical that the investigation be as thorough and evidence-based as possible. Understanding exactly what happened isn’t just about accountability—it’s about making sure every possible factor is considered, so that we can take meaningful steps to prevent something like this from happening again.
