Commentary by Attorney Michael Grossman
When a vehicle leaves the roadway and overturns, the scene can appear to tell its own story. But what looks simple from the outside can have causes that aren’t obvious without digging into the details. That’s why a careful, methodical investigation matters.
Did investigators take a full, detailed look at the crash scene?
In a rollover caused by an over-correction, it’s important to understand what led to the initial departure from the lane and how the driver’s actions unfolded in the seconds after. Mapping tire marks, measuring distances, and reconstructing steering inputs can reveal whether the reaction was forced by circumstances beyond the driver’s control. These steps take time and skill, and without them, the conclusions may rest on assumption rather than evidence.
Was a vehicle defect considered?
Mechanical issues—like a blown tire, steering failure, or brake malfunction—can set off a chain of events that ends in a rollover. A truck’s suspension and stability control systems can also play a role in how it reacts to sudden steering. Without a close inspection, these possibilities can be overlooked, leaving questions unanswered.
Has all available electronic data been gathered?
Modern pickups often store pre-crash information, including speed, throttle position, and steering angles. That data, paired with GPS tracking or dash camera footage if available, can provide a clear record of the moments before control was lost. Collecting it quickly is essential, because once a vehicle is moved or repaired, that information can disappear.
Pursuing these questions ensures that the explanation for a crash comes from hard facts, not guesswork. It’s the difference between a surface-level answer and one that can stand up to scrutiny.
Key takeaways:
- Rollover crashes need careful scene analysis to understand the full sequence of events.
- Mechanical failures can trigger loss of control and must be ruled out through inspection.
- Onboard vehicle data can provide a precise timeline of driver and vehicle actions.
