Commentary by Attorney Michael Grossman
I talk about single-vehicle accidents a lot on this blog and how people tend to just blame the driver without considering any extenuating possible circumstances. Commercial truck drivers aren't exempt from this despite the fact they have unique factors they have to worry about beyond what the average motorist has to consider.
Did the trailer's cargo shift? Was the truck not being maintained properly by the driver's employer? Was the victim pressured to work long hours or to meet unreasonable deadlines? Has the truck been inspected for potential defects? Were there any reckless drivers who cut off the truck and left the scene? Did the driver's cab lack the structural integrity to withstand what should have been a survivable crash?
These are the kinds of questions I see answers to when working with independent accident reconstructionists. When I look at police investigations of commercial vehicle wrecks, I rarely see this kind of depth. They typically lack the tools and training needed for such challenging accident investigations.
That's why getting the full story for families affected by crashes like this often require independent investigations. If they're able to dedicate the time and resources needed for getting clear answers, they can help ensure nothing important slips through the cracks.
