Commentary by Attorney Michael Grossman
Single-vehicle crashes like this tend to leave more questions than answers. Without other drivers involved, authorities may assume the cause is obvious and move on before conducting a full investigation. However, experience has shown that these accidents can be far more complex than they appear, making it crucial to ask the right questions.
Did investigators take the time and use the right tools to fully analyze the crash? A vehicle leaving the roadway could be influenced by road hazards, poor visibility, or evasive maneuvers. If authorities lacked the resources or expertise for a detailed reconstruction, they may have missed critical evidence that explains what happened.
Did they consider whether a vehicle defect played a role? A sudden loss of control can result from brake failures, steering malfunctions, or tire blowouts. Additionally, if seatbelts or airbags didn’t function properly, injuries could have been more severe than they should have been. Were investigators thorough in inspecting the vehicle to rule out these possibilities?
Did they secure all available electronic evidence? The vehicle’s Engine Control Module (ECM) may contain data on speed, braking, and steering inputs leading up to the crash. GPS records, cellphone activity, and nearby surveillance footage could also provide key insights. Have authorities worked to preserve this information before it’s lost?
If authorities can provide clear answers to these questions, it's generally a sign they're taking the investigations seriously. However, if their answers come up short, that can be a family's sign that independent professionals may need to step in and make sure nothing important slipped through the cracks.
