Commentary by Attorney Michael Grossman
When a serious crash results in loss of life, particularly in complex scenarios like collisions with animals, it’s important not to stop at the obvious cause. A deer in the road might be what started the chain of events—but the real story is what happened after that. Understanding the full picture means asking questions others might overlook.
Was the investigation conducted with enough depth?
When vehicles veer off the road and roll over, investigators should be reconstructing the sequence of events with precision. Did they analyze skid marks, the truck’s final position, and any signs of evasive action? In rural areas, where incidents like this are more common, investigative resources can vary. Without careful scene documentation and a full timeline, key details may slip by unnoticed.
Has the possibility of a mechanical issue been explored?
Striking a deer doesn’t always cause a vehicle to overturn. That raises questions: was there a brake failure, steering problem, or structural issue that made it harder to maintain control? Did a tire fail during or after the collision? Unless the vehicle is inspected by someone looking specifically for these issues, the cause may be chalked up to chance when there could be a deeper explanation.
Has all digital data from the vehicle been reviewed?
Today’s vehicles can record exact speed, braking force, steering angle, and more. That data can confirm whether the driver reacted as expected and how the truck responded. If any phones or GPS systems were in use, that information could also shed light on what the occupants were doing in the seconds before the crash. Without checking, investigators may miss important facts.
In crashes where the cause seems straightforward, the most important questions are often the ones nobody thinks to ask. A deeper look at the vehicle, the scene, and the digital footprint may reveal answers that change the understanding of what really happened.
- Crashes involving animals should still get full-scale investigation.
- A defect in the vehicle could have played a role in the loss of control.
- Electronic records often hold details the scene alone can’t show.
